Terms & Conditions
Master service terms governing use of VoiceCosmos. Effective 2026-05-05. The full executable agreement is provided at contract signing and forms the binding legal relationship.
1. Service description
VoiceCosmos provides a voice-AI platform comprising the ARIAN voice operating system, six Day Zero AI agents per tenant, and 33 vertical-specific configurations. Service is delivered as SaaS via the customer\'s tenant subdomain.
2. Trial period
New tenants receive a 14-day trial. No payment is taken during trial. Conversion to paid plan requires explicit confirmation. Trial data persists into the paid account if you convert.
3. Pricing and billing
Pricing is per the published Pricing page or per signed order form. Billed monthly via Stripe (credit card) or annually via invoice (NET-30). VAT charged where applicable per German and EU rules.
4. Service levels
- Target uptime: 99.5% monthly (excluding scheduled maintenance)
- Voice latency target: sub-500ms first-word for inbound calls
- Support response: business hours within 4 hours, critical incidents 24/7 within 30 minutes
5. Acceptable use
You may not use VoiceCosmos to: process data without lawful basis; impersonate a regulated professional (medical, legal) without disclosure; record calls in jurisdictions requiring two-party consent without obtaining it; or violate applicable consumer protection rules. Violations can result in immediate suspension.
6. Data ownership
You retain full ownership of all data you input into VoiceCosmos and all data generated by your tenant. We process it as Data Processor only — see the DPA. On termination, you can export all your data in standard formats; we delete it from active systems within 30 days.
7. Liability
Aggregate liability capped at fees paid in the 12 months preceding the claim. Excluded: indirect, consequential, lost-profit damages. Standard exceptions for gross negligence, wilful misconduct, IP infringement, and confidentiality breaches.
8. Governing law
German law applies. Jurisdiction: Munich. Customers in EU member states retain mandatory consumer protections.
Negotiated terms for enterprise customers can override the above via signed master service agreement.
